Copyright and DMCA Policy

In short

If you believe something on our website, or on an online store or managed website we host, copies your work without permission, send us a notice with the details listed here. We act on valid notices, forward them to the person who posted the content, and accept counter-notices. Accounts that infringe repeatedly are closed.

What this policy covers

GetJewelryPOS respects other people’s creative work, and we expect the stores using our service to do the same. This policy explains how copyright owners can report infringing material, and how the people who posted it can respond.

It applies to:

  • our own website, getjewelrypos.com, including the blog and help center;
  • online stores generated from a merchant’s catalogue and managed websites that we host for jewelry stores;
  • images, text and files that merchants upload into the GetJewelryPOS service and that are publicly visible.

Product photos are the most common issue in our trade. A ring photographed by one jeweler or a manufacturer may be copied onto another store’s site. If that has happened to you, this is the right place.

Merchants agree in our Terms of Service that they own, or have permission to use, everything they upload.

Reporting infringement in the United States (DMCA notice)

We follow the notice-and-takedown process of the US Digital Millennium Copyright Act (17 U.S.C. § 512). To be valid, your notice must be in writing and include all of the following:

  1. Your signature. A physical or electronic signature (typing your full name is fine) of the copyright owner or a person authorized to act for them.
  2. The work. A description of the copyrighted work you say is infringed, such as “my product photo of an 18K halo engagement ring, first published on my site”. If several works are involved, a list.
  3. The material. The exact web address (URL) of each page or image you want removed, with enough detail for us to find it.
  4. Your contact details. Your name, postal address, telephone number and an address where we can reach you.
  5. Good-faith statement. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent or the law.
  6. Accuracy statement. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

Where to send it

Use the form on our contact page and choose the subject that fits best, writing “Copyright notice” at the start of your message. You can also press the Show email button on that page to see our address and send the notice there. Attach links or screenshots that show your original work if you have them.

Please be accurate. Under US law, a person who knowingly makes a false claim that material is infringing may be liable for damages, including costs and legal fees.

Before sending a notice, consider whether the use may be fair use or licensed. If you are unsure, you may wish to ask a lawyer.

What we do with a notice

When we receive a complete notice, we:

  1. review it and, if anything required is missing, tell you what to add;
  2. remove or disable access to the material, usually within 2 business days;
  3. tell the merchant or person who posted it, and send them a copy of the notice (with your contact details, so they can contact you or file a counter-notice);
  4. keep a record of the notice.

For content inside a merchant’s store, we may first ask the merchant to remove it themselves, if they can do so quickly.

Counter-notice

If your material was removed and you believe it was a mistake or that you have the right to use it, you can send a counter-notice. It must include:

  1. Your signature (physical or electronic).
  2. What was removed and the URL where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed because of a mistake or misidentification.
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the US federal district court for your address (or, if you are outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who sent the original notice or their agent.

Send it the same way as a notice, through the contact page, with “Counter-notice” at the start of your message.

When we receive a valid counter-notice, we send a copy to the person who sent the original notice. Unless they tell us within 10 business days that they have filed a court action to stop the use, we will restore the material between 10 and 14 business days after we received the counter-notice.

Repeat infringers

We close the accounts of merchants and users who repeatedly infringe others’ copyrights, in appropriate circumstances. As a rule, an account that receives three valid notices which are not successfully countered within a 12-month period will be closed. We may act sooner for clear or serious infringement. A closed account keeps the normal window to export its own lawful data, as set out in our Terms.

Notices from outside the United States

We serve stores in the United States, the United Arab Emirates and Pakistan. The DMCA is a US law, but we accept notices from copyright owners anywhere.

If you are in the UAE, Pakistan, the EU or another country, send the same information listed above. You do not need to refer to the DMCA. Tell us which country’s law you rely on. We will review the notice against the applicable law, including the UAE copyright law and Pakistan’s Copyright Ordinance, and take the steps that law requires. Where the merchant is in a different country from you, we may ask both sides for more information.

Trademarks and other complaints

This process is for copyright. For trademark concerns, such as a store using a brand name or logo it is not allowed to use, or for counterfeit goods, contact us through the same page with the details and evidence. We will review the complaint and may pass it to the merchant, who is responsible for its own listings.

Changes

We may update this policy as the law or our service changes. The date at the top shows the current version.
