Terms of Service
In short
You can try GetJewelryPOS free, then pay monthly or yearly with no minimum contract and cancel any time. Your data stays yours and you can export it after you leave. You remain responsible for your own taxes, gold rates, card processing and dealings with your customers.
About these terms
These Terms of Service (“Terms”) are the agreement between GetJewelryPOS (“we”, “us”) and the business that signs up for our hosted point-of-sale software or our managed website service (“you”, “the merchant”). By creating an account, starting a trial, or paying for a plan, you agree to these Terms on behalf of your business. If you do not agree, please do not use the service.
The person who signs up must be authorized to bind the business. GetJewelryPOS is a business service and is not offered to consumers for personal use.
Our legal entity details are being finalized. The registered legal name and address will be added to this page when they are confirmed; until then, “GetJewelryPOS” means the business that operates getjewelrypos.com.
What the service is
GetJewelryPOS is cloud software for jewelry stores. It runs in a web browser and our mobile app; there is nothing to install on your server. Depending on your plan, it includes point of sale, serialized inventory and certificate details, repair job sheets, layaway and instalments, gold and weight-based pricing, customer records, barcode labels, multi-location stock, reports and an online store generated from your catalogue. Plan contents are listed on our pricing page.
We may improve, change or retire features over time. If we remove a feature that is a main part of your paid plan, we will give you reasonable notice and, where appropriate, a pro-rata refund for prepaid time you can no longer use.
Free trial
New accounts can use GetJewelryPOS free for 14 days. If you stop during the trial, you are not charged. At the end of the trial, you choose a plan to keep using the service. If you do not, the account is paused and your trial data is kept for a limited time so you can return or export it, then deleted.
Plans, billing and taxes
Monthly or annual billing
You can pay monthly or annually. Prices are shown on the pricing page in the currency for your country. Subscriptions renew automatically at the end of each billing period until you cancel.
No minimum contract
There is no minimum contract term. You are only committed to the billing period you have paid for.
Price changes
We may change prices for future billing periods. We will tell you at least 30 days before a change affects your renewal. If you do not agree, you can cancel before the new price applies.
Taxes on our fees
Our prices may not include sales tax, VAT or other taxes. Where the law requires us to charge tax on our subscription (for example UAE VAT or Pakistan sales tax on services), it will be shown on your invoice. See our Refund Policy for how tax is handled on refunds.
Late or failed payments
If a payment fails, we will let you know and retry. If it is still unpaid after a reasonable grace period, we may limit the account to read-only or pause it until payment is made. We will not delete your data for non-payment without first giving notice.
Cancellation and your data
You can cancel at any time from your account or by contacting us. Cancellation takes effect at the end of your current billing period; you keep full access until then. Refunds are covered in the Refund Policy.
After your subscription ends, you can export your data for 30 days. Exports include your products, customers, sales and other records in common file formats. After that period, we delete your data from the live service; backup copies are overwritten on their normal cycle. If you need more time, ask before the period ends.
Your data and our role
You own the data you put into GetJewelryPOS: your products, prices, customers, staff, sales, repair tickets, layaway records and images. You give us permission to host, copy, process and display that data only as needed to provide, secure, back up and support the service.
For personal data about your customers and staff, you are the controller and we act as your processor (service provider). Our Privacy Policy explains this in more detail. You are responsible for telling your customers how you use their data and for having a lawful reason to collect it, including consent for marketing SMS, WhatsApp or email messages you send through the software.
We may use anonymous, aggregated information about how the service is used (for example, how many repair tickets are created across all accounts) to improve it. This never identifies you or your customers.
Your responsibilities as a merchant
You are responsible for running your business lawfully. In particular:
- Taxes. You choose and set your own tax rates, tax groups and invoice wording. You are responsible for charging, recording and filing sales tax, VAT, GST or any other tax correctly in your country and state. The software helps you record tax; it does not file returns or give tax advice.
- Gold rates and pricing. You enter today’s gold rate for each karat yourself. The software does not fetch or quote live rates. You are responsible for the rates, making charges, stone values, weights and purity you enter, and for the prices that result.
- Consumer and trade law. You are responsible for following the laws that apply to your sales, such as product descriptions, karat and metal marking, gemstone disclosures, warranties, returns, layaway and instalment rules, receipt requirements and consumer protection laws in your market.
- Card payments. GetJewelryPOS works with your card processor and card terminal, but we do not process card payments. Your agreement with your card processor or bank is separate from these Terms, and that provider is responsible for card processing, settlement, chargebacks and card security.
- Accounts and access. You control who on your staff has access and what each role can do. Keep passwords private, remove staff who leave, and tell us promptly if you suspect unauthorized access.
- Accuracy of records. Check your stock counts, cash register counts and reports. The software records what is entered into it.
- Backups of your own. We back up the service regularly, but we recommend you export important records periodically for your own files.
Acceptable use
You agree not to use the service to:
- break any law, including tax, anti-money-laundering, sanctions, consumer and data protection laws;
- sell stolen goods, counterfeit items, or goods you are not permitted to sell;
- send spam or messages to people who have not agreed to receive them;
- upload malware, or try to break into, overload, scan or disrupt the service or other customers’ accounts;
- copy, resell, reverse-engineer or build a competing product from the software, except where the law allows it;
- share one account between separate businesses outside what your plan allows;
- infringe anyone’s copyright, trademark or other rights (see our DMCA and copyright policy).
If you break these rules, we may suspend the affected part of your account. Where possible, we will tell you first and give you a chance to fix the problem. For serious or illegal misuse, we may suspend immediately.
Managed website service
Some plans, including the Showroom Bundle, include a managed custom website. The online store generated from your catalogue is separate and included in every plan.
Setup fee
A managed website may have a one-time setup fee, shown on the pricing page before you order. The setup fee covers planning, design and build. Refund rules for the setup fee are in the Refund Policy.
Your content
You own the content you give us for your website: your text, product photos, logo, brand names and images. You confirm you have the right to use them and give us permission to use them to build and run your site. Text and designs we create for your site become yours once the setup fee is paid, except for our underlying templates, code and tools, which we keep and license to you while your subscription is active.
Your domain
Your domain name stays yours. It should be registered in your business’s name. If we help you register or connect a domain, we do so on your behalf, and we will give you the access you need to move it if you leave. We do not hold domains hostage.
When you leave
If you cancel the managed website, we will provide an export of your content (text and images). Our templates and hosting stay with us.
Marketing tools
Where a plan includes pre-built CRM pipelines and follow-up automations, you are responsible for using them in line with marketing and messaging laws in your country, including consent and opt-out rules.
Availability and support
We work hard to keep GetJewelryPOS available every day and to fix problems quickly. We provide the service on a best-effort basis; we do not promise a specific uptime percentage, and there may be planned maintenance or occasional interruptions outside our control (for example internet, hosting or power outages). Where possible, we schedule maintenance outside busy trading hours and announce it in advance.
Support is available through WhatsApp, the contact form and email during the hours shown on our contact page.
Third-party services
The service can connect to other products, such as card terminals, WooCommerce, SMS or email providers and accounting tools. Those services are provided by other companies under their own terms. We are not responsible for them, though we will help you with the connection on our side.
Our intellectual property
The GetJewelryPOS software, website, brand and documentation belong to us or our licensors. While your subscription is active, we give you a non-exclusive, non-transferable right to use the service for your business. You may not remove our notices or use our brand in a way that suggests we endorse you.
If you send us feedback or suggestions, we may use them freely to improve the service.
Disclaimers
Apart from what these Terms state, the service is provided “as is” and “as available”. To the extent the law allows, we do not give other warranties, such as fitness for a particular purpose. Gold calculations, tax examples and guides on our website are general information; see our Disclaimer.
Nothing in these Terms removes rights you have under laws that cannot be excluded by contract.
Limitation of liability
To the extent the law allows:
- We are not liable for indirect or consequential losses, such as lost profits, lost sales, lost business opportunities or damage to reputation.
- We are not liable for losses caused by your own entries (such as gold rates, prices or tax settings), your card processor, your internet connection or hardware, or third-party services.
- Our total liability for any claim relating to the service is limited to the fees you paid us for the service in the 12 months before the event that caused the claim.
These limits do not apply to liability that cannot be limited by law, such as liability for fraud, or for death or personal injury caused by negligence.
Indemnity
If someone brings a claim against us because of the content you uploaded, the way you used the service, or your breach of these Terms or the law, you agree to cover our reasonable losses and costs from that claim.
Suspension and termination
You can end these Terms by cancelling your subscription. We can end them or suspend your account if you seriously break these Terms, do not pay after notice, or if the law requires it. If we end the service for our own reasons (not because of your breach), we will give you at least 30 days’ notice and refund any prepaid fees for the unused period. In every case, you keep the 30-day data export window, unless the law prevents it.
Governing law and disputes
The governing law and courts for these Terms are to be confirmed with the company’s registration, and this section will be updated when that is done. Mandatory consumer or business protection laws of your own country (the United States, the United Arab Emirates or Pakistan) still apply where they cannot be excluded.
Before starting any formal dispute, please contact us so we can try to solve the problem informally. Most issues are resolved quickly by talking.
Changes to these Terms
We may update these Terms as the service and the law change. The date at the top shows the current version. If a change materially affects your rights, we will notify you by email or in the app at least 30 days before it takes effect. If you continue using the service after that date, the new Terms apply. If you do not agree, you can cancel before they take effect.
General
If any part of these Terms is found unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your account to another business without our agreement; we may transfer these Terms as part of a merger or sale of our business. These Terms, together with the Privacy Policy and Refund Policy, are the whole agreement about the service.
